Important: This Terms of Service (“Terms”) governs your access to and use of theclaimologyreport.com and claimologyreport.com (the “Site”) and any content, files, newsletters, events, and related features offered by The Claimology Report (“Claimology,” “we,” “us,” or “our”), a division of Bureau of Claim Scene Investigations, Inc. (BCSI). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to all visitors and users of the Site, including readers of articles, recipients of newsletters, event registrants, and downloaders of resources (e.g., white papers, checklists, templates). The Site is intended for users who are at least 16 years old. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

By submitting your email, you consent to receive the communications you request (e.g., newsletters, event notices). You can unsubscribe at any time via the link in our emails. 7) Intellectual Property & License to Use the Site
A) Our rights
The Site and its content—including text, graphics, logos, icons, images, PDFs, templates, audio/video, data compilations, and software—are owned by Claimology/BCSI or our licensors and are protected by intellectual property laws. Claimology, The Claimology Report, associated logos, and product names are trademarks or service marks of BCSI.
B) Your limited license
Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Site for your internal, non‑commercial purposes. You may download copies of our publicly available PDFs and templates for internal use, provided you do not remove branding, copyright, or attribution notices.
C) Restrictions
You may not: (i) copy, reproduce, modify, adapt, translate, distribute, or publicly display Site content except as expressly permitted; (ii) sell, license, or otherwise exploit content commercially; (iii) use automated means (bots, scrapers) to access the Site without our written permission; (iv) circumvent security or access controls; (v) remove proprietary notices; or (vi) use the Site to build a competing service.
8) Downloaded Resources; Kits; Licensing
A) Free items
Certain resources (e.g., Claim + Tell Kit (Mini)) may be offered at no charge, often in exchange for an email address. Free items are licensed for internal use by a single individual or team within a single legal entity. Redistribution outside your organization requires permission.
B) Paid items
Paid resources (e.g., Claim + Tell All Kit (Full)) are licensed per purchaser for internal use. Unless a separate agreement is signed, you may not resell, sublicense, or publicly post paid files. For multi‑seat or enterprise licenses, contact us for a custom agreement.
C) Updates
We may issue updates or revisions to resources. Access to updates may require a current subscription or a separate purchase depending on the product.
9) Contributor Submissions; Feedback
- You represent that you have the rights to submit it and that it is accurate, lawful, and non‑confidential.
- You grant Claimology/BCSI a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from your submission in any media, with attribution per our editorial standards.
- We may edit or decline to publish any submission in our discretion.
- You retain ownership of your original content subject to this license grant.
For sponsored or co‑branded content, a separate written agreement will apply.
10) Prohibited Conduct
You agree not to: (a) use the Site for unlawful purposes; (b) submit false, misleading, or deceptive information; (c) infringe or violate intellectual property, privacy, or publicity rights; (d) upload viruses, malware, or harmful code; (e) attempt unauthorized access or disrupt Site operations; (f) use automated scraping without permission; (g) harass, threaten, or abuse others; or (h) misuse contact forms or email for spam.
11) Third‑Party Links, Tools & Embeds
The Site links to third‑party resources (e.g., industry organizations, weather services) and may embed third‑party media. We are not responsible for third‑party content, policies, or practices. Your interactions with third‑party sites are governed by their terms and policies. Inclusion of a link does not constitute endorsement.
12) Events & Webinars
By registering for an event or webinar, you agree that we may (i) use your registration data to send reminders and follow‑ups; (ii) host events on third‑party platforms subject to their terms; (iii) record sessions for later viewing; and (iv) moderate Q&A at our discretion. Event schedules and speakers may change. You may not share paid access links publicly.
13) Research Invitations & Surveys
From time to time, we may invite participation in surveys or research. Participation is voluntary. Unless otherwise stated, we aggregate and anonymize responses for publication. If incentives are offered, eligibility and fulfillment terms will be stated with the invitation.
14) Privacy; Cookies
Your use of the Site is subject to our Privacy Policy, which explains what personal data we collect and how we use it. We use cookies and similar technologies; manage your preferences via our cookie banner and browser settings.

We do not warrant that the Site will be uninterrupted, secure, or error‑free, or that defects will be corrected.
17) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CLAIMOLOGY/BCSI OR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED US $100 OR THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE AT ISSUE IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitations of certain damages; portions of this section may not apply to you.
18) Indemnification
You agree to indemnify, defend, and hold harmless Claimology/BCSI and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (i) your use of the Site; (ii) your violation of these Terms; (iii) your submissions or content; or (iv) your violation of any law or third‑party right.
19) DMCA; Copyright Complaints
If you believe content on the Site infringes your copyright, send a notice to dmca@theclaimologyreport.com including: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and location; (4) a statement of good‑faith belief; (5) a statement under penalty of perjury that the information is accurate and you are the owner or authorized to act; and (6) a physical or electronic signature. We may remove or disable access to the material and, in appropriate circumstances, terminate repeat infringers.
20) Termination; Suspension
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. Upon termination, your right to use the Site ends immediately, but Sections 7–9 and 16–25 survive.
21) Governing Law; Venue

23) Export Controls & Sanctions
You agree to comply with all U.S. and international export laws and sanctions. You may not use or access the Site if you are located in a country or territory subject to comprehensive sanctions or are on any restricted party list.
24) Open‑Source & Third‑Party Components
The Site may include open‑source or third‑party components subject to their own licenses. To the extent required, those licenses are incorporated by reference. Nothing in these Terms limits your rights under applicable open‑source licenses.
25) Miscellaneous
- Entire Agreement: These Terms, along with any applicable product‑specific terms and our Privacy Policy, constitute the entire agreement between you and us regarding the Site.
- Severability: If any provision is found unenforceable, the remainder remains in effect.
- No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: You may not assign any rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or asset sale.
- Headings: Headings are for convenience only and have no legal effect.
